The registration of a design is fundamental since it protects those investing resources and talent in the search for form, materials or colours. The design must be new and original. In this context, originality lies in the distinctive capacity possessed by the design compared to other recognized designs, models that can be assessed by the general impression that the design creates in an informed user, regardless of any aesthetic value. The rights conferred by the registration of designs imply a monopoly in the manufacture, use and marketing of a product that incorporates the registered design or model. Violation of these rights constitutes counterfeiting.
