International brand

An international trademark is a trademark valid in one or more states adhering to the Madrid Agreement and/or Protocol and its registration is carried out by the World Intellectual Property Organization (WIPO) based in Geneva, Switzerland. Unlike the European Union trademark, the international trademark is not a supranational trademark regulated in the same way in all the countries acceding to the convention, but rather a centralized procedure for filing an application to register a trademark which produces as many independent national trademarks as there are countries designated in the registration application.

    Once the trademark is registered internationally, it is subject to the respective national laws, unless one or more states signal their refusal to protect it.

    The application to register an international trademark relies on an application to register the trademark in a country of origin or an application to register a European Union trademark.

Registering a trademark in a single foreign country

If you wish, you can file a trademark application in a single foreign country while maintaining the priority of the filing date of the Italian application, provided that the foreign filing takes place within six months and the priority is claimed expressly. In this case, the duration and judicial protection of the trademark are those provided for by current legislation in the individual foreign country. State-by-state filing is convenient only if the market for the products and services covered by the trademark is well circumscribed within individual countries.

Duration

An international trademark is valid 10 years from the date the application is filed. This duration can be extended indefinitely by renewing the registration at the end of each 10-year period.
